P R E S S   R E L E A S E   For immediate release.

Fairfield County Engineer, Frank W. Anderson would like to clarify some issues on County Roads resulting from the Yard-Sign article printed in the June 15, 2008, edition of the Lancaster Eagle-Gazette.  Ohio Revised Code 5589.33 states, no person shall place within the limits of the right-of-way or affix any sign, poster, or advertisement to any tree or utility pole within the right-of-way of any public highway outside of municipal corporations.  An additional code further states that violations of this section of the code are considered a minor misdemeanor.  The Engineers Office does not issue permits for such signs due to this law.  There may also be Township Zoning rules that are being violated by such placement.  We address signs placed along the full length of the road, not just within 225 feet of an intersection.  This includes all private signage illegally placed, whether they are political or not.

Our summer mowing program started in early May and continues until November, depending on weather conditions.  We mow the area closest to the paved surface as long as weather and manpower issues allow; and at least two times in this period, we mow the full width of the roads rights-of-way.  Therefore, items placed illegally in the roads easement or rights-of-way area are subject to removal.  Just last year, surgery was required to remove a piece of a sign wire from the shoulder of an employee who hit it while mowing.

I encourage the public to contact the Engineers Office about the width of the road rights-of-ways or easement on their particular road due to the varying widths.  Also, I would like to remind the public of the requirement of a free permit from the Engineers Office for any proposed alteration or work being performed within a County Roads rights-of-way.  Anything placed within the rights-of-way is subject to removal.  This would include but not limited to signs, rocks, trees, bushes, plantings of any type, non-conforming mailboxes, fence structures etc.  Citizen cooperation by removing all obstacles is appreciated.
